Please read these Terms of Use carefully before using the FlexMotion Stretch Academy website or enrolling in any of our educational programs.
1. Acceptance of Terms
By accessing, browsing, or using the FlexMotion Stretch Academy website (the "Website"), or by enrolling in, participating in, or otherwise using any of our educational programs, courses, workshops, or services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use (the "Terms").
If you do not agree to these Terms, you must discontinue use of the Website and Services immediately.
You must be at least 18 years of age to use this Website or participate in our programs. By using the Website or Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
These Terms constitute a legally binding agreement between you ("you," "your," or "user") and FlexMotion Stretch Academy ApS ("FlexMotion," "we," "us," or "our"), a company registered in Denmark with its registered office at Falkevej 17, 4600 Koge, Denmark.

FlexMotion Stretch Academy provides online stretching and mobility education programs, courses, workshops, and related learning resources to participants located throughout Canada. Our Services are educational in nature and include:
- Structured stretching education programs (ranging from 6 to 12 weeks)
- Mobility and flexibility development courses
- Online classes with video lessons and guided practice sessions
- Wellness workshops covering movement awareness, posture, and healthy habits
- Downloadable educational resources including worksheets, mobility plans, and stretching guides
- Access to a learning progress dashboard and educational checkpoints
All Services are delivered online and are designed for educational purposes only. Our programs are not medical treatment, physical therapy, physiotherapy, or any form of clinical healthcare. They do not replace professional medical advice, diagnosis, or treatment.

3. User Obligations

- Any collection or use of product listings, descriptions, or prices for commercial purposes
- Any derivative use of the Website or its Content
- Any downloading or copying of account information for the benefit of a third party

The FlexMotion name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of FlexMotion Stretch Academy ApS. You may not use these marks without our prior written permission.
5. Disclaimers
The Website and Services are provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, FlexMotion Stretch Academy ApS disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Website or Services will be uninterrupted, timely, secure, or error-free

6. Limitation of Liability
To the maximum extent permitted by applicable law, FlexMotion Stretch Academy ApS, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from your access to, use of, or inability to access or use the Website or Services
- Damages resulting from any conduct or content of any third party on the Website
- Damages resulting from unauthorized access, use, or alteration of your transmissions or content
- Any personal injury or property damage resulting from your participation in our educational programs
In no event shall our total liability to you for all claims arising out of or relating to the use of the Website or Services exceed the amount you have paid to FlexMotion Stretch Academy ApS in the twelve (12) months preceding the event giving rise to the liability, or one hundred euros (EUR 100), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
7. Indemnification

- Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right
- Your violation of any applicable law, rule, or regulation
- Any claim that your actions caused damage to a third party

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Denmark, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms, including any disputes regarding the existence, validity, or termination thereof, shall be subject to the exclusive jurisdiction of the courts of Denmark, specifically the City Court of Roskilde (Retten i Roskilde) as the court of first instance.
If you are a consumer residing in the European Union, you may also be entitled to bring proceedings in the courts of your country of residence. Nothing in these Terms affects your rights as a consumer under mandatory consumer protection laws of your country of residence.
11. Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Website or Services, the parties agree to first attempt to resolve the matter through informal negotiation. If informal negotiation does not resolve the dispute within 60 days from the date of the initial written complaint, either party may pursue formal legal proceedings as outlined in Section 10 (Governing Law and Jurisdiction).
For consumers residing in the EU, you may also submit complaints through the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution proceedings before a consumer arbitration board, but we will consider participating on a case-by-case basis.
12. Termination
We reserve the right to suspend or terminate your access to the Website and Services, in whole or in part, at any time and for any reason, including but not limited to a breach of these Terms, without prior notice or liability.
Upon termination, your right to use the Website and Services will immediately cease. If you have been enrolled in an active program, we will handle any remaining obligations (such as access to previously purchased materials) on a case-by-case basis at our discretion.
All provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.
13. Changes to These Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 14 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.
Notice of changes will be provided through one or more of the following methods:

14. Participation and Educational Disclaimer
All programs, courses, workshops, and educational materials provided by FlexMotion Stretch Academy are intended exclusively for educational and personal development purposes. Participants are responsible for their own decisions regarding the application of any techniques, exercises, or knowledge gained through our programs.
Participation in any of our programs does not create a professional-client, therapist-patient, or medical provider-patient relationship. We do not provide medical advice, diagnosis, or treatment of any kind.
No financial, career, medical, professional, or personal guarantees are provided. Individual experiences and outcomes vary, and we make no representations regarding specific results from participation in our programs.
15. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms will remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy and Cookies Policy, constitute the entire agreement between you and FlexMotion Stretch Academy ApS regarding your use of the Website and Services, and supersede all prior and contemporaneous written or oral agreements, communications, and other understandings relating to the subject matter hereof.
